CannaSense uses a unique legal framework. The Compassionate Use Act of 1996 is a California Law that allows anyone to become members of a cannabis collective with the recommendation of a doctor. Article 4 Section 1 of the US Constitution says: Full Faith and Credit shall be given in each State to the public Acts, Records, and judicial Proceedings of every other State. And the Congress may by general Laws prescribe the Manner in which such Acts, Records and Proceedings shall be proved, and the Effect thereof.
Article IV, Section 1 ensures that states respect and honor the state laws and court orders of other states, even when their own laws are different.
Under the Affordable Care Act, also known as ObamaCare, patients can now see their doctors through "telemedicine" services and not have to leave their homes. Instead they can have teleconference calls from home with their doctors and get their prescriptions. CannaSense partners with a CA telemedicine doctor service called PrestoDoctor. We provide patients with a teleconference appointment with a CA doctor. Through this process, every patient is given a treatment plan, a physical medical cannabis card, and a signed recommendation for membership with Cannasense. So CannaSense essentially makes everyone a California patient under the protections of the Compassionate Use Act. Though they may live in another state, through this process, they are California patients. The recommendation from PrestoDoctor is sent to Cannasense for approval, which usually takes one business day, and then they are assigned a patient ID, after which they are able to log in to their account and order from the Apothecary store on the CannaSense website.
There are several legal safeguards with CannaSense, the first of which is our compliance within the legal framework mentioned above. The medical card is an important component as well as the discretion and respect for privacy CannaSense uses with respect to our shipping procedures. The greatest benefit of being a patient with CannaSense is the CannaSense foundation, whose primary purpose is to provide legal defense teams at no cost to any patient or member who has legal issues as a result of using cannabis.
